AFFIDAVIT OF DURESS AND NOTICE OF JUDICIAL MISCONDUCT

AFFIDAVIT OF DURESS AND NOTICE OF JUDICIAL MISCONDUCT

Forrest Frederick Bishop deposes and says as follows:

I appeared for a 1:00 PM proceeding in the Courtroom 1 at the Shoreline Courthouse, on November 24th, 2004, the Honorable Douglas Smith presiding. I was made to wait until approximately 2:30 PM, after a number of 2:00 PM hearings had been heard. Judge Smith commented to Mr. Santos roughly to the effect (paraphrased) "look at all the books and stuff this guy (myself) brought with him, why don’t you have your files together", which I found embarrassing for Mr. Santos.

Judge Smith asked Mr. Ben Santos (alleged Prosecutor for King County or Washington State or something) if he were ready to proceed; Mr. Santos said he wasn’t. I moved to dismiss, Judge Smith said he wasn’t hearing motions that day. Various attorneys made motions that were heard, before and after. After what sounded to myself as rude, threatening, and most unpleasant comments directed at me, over a period of perhaps less than a minute total, Judge Smith then did order me to cease speaking and go sit down. I don’t remember the exact words. I do remember the tone, which was, in my view, sharp, harsh, and a disrespectful trespass. I stood there just stunned for approximately all of 1-2 seconds, whereupon Judge Smith told the Bailiff (or other title of the woman at the side desk) to "call the police", or similar words. The Sheriff appeared at the door shortly, after I had returned to my seat.

This apparent public insinuation of criminal misbehavior- Failure to Sit Within Two Seconds, or something like that- was embarrassing and humiliating to myself. I believe it constitutes slander. Additionally, I am now quite Under Duress, and feel I am under threat of injury or worse, for any pretext given or indeed for no reason at all, at every moment spent within the Shoreline Courthouse, aside and apart from any other consideration.

Judge Smith then heard everything else on the docket, clearing out the room, before finally hearing me at about 4:00 PM. I believe he didn’t want any witnesses. A number of additional character insinuations, ad hominem attacks, and other such allegations, were made by Judge Smith during this period, which I rebutted. As an example, the averment "Oh, so you’re one of those people" was rebutted with "no sir, I am not one of those people".

This matter, beginning with the unlawful "contact" and false accusation, on April 1st, 2004, and continuing to the present day, has caused me a great deal of injury. I have experienced, among other things, headaches, nausea, indigestion, loss of appetite, insomnia, intense revulsion, and have come very close to vomiting on a number of occasions, particularly when reviewing the cited RCWs, when witnessing court proceedings, and even as I write this now. My health is deteriorating as a direct result of this extended "contact".

The events of November 24th, 2004, partially testified supra, have caused myself considerable, additional physical, mental, emotional, and financial injury. The misconduct and resulting injuries testified to above are by no means inclusive.
